USDOT + Oral Fluid Testing * Final Rule

The US Department of Transportation (DOT) issued a final rule on May 2, 2023, that amends their drug testing program to include oral fluid as a specimen type, effective June 1, 2023. 

What To Know:

  • U.S. Dept. of Health and Human Services will need to certify at least two laboratories for federally regulated oral fluid testing and the devices to be used.  This has not be done yet.
  • All labs involved will be keeping clients updated along the way.
  • The Final Rule harmonizes with the pertinent section of the HHS oral fluid Mandatory Guidelines from January 2020.
  • Oral Fluid Testing is NOT replacing Urine Testing; it is an additional methodology.
    • Helping to combat cheating
    • Less Intrusive when direct observation is required for urine testing with gender concerns/requirements.
  • Scientifically viable and legally defensible
